ACTUAL ISSUES OF THE CRIMINAL LAW REFORM

It has been a few years since the criminal law specialists in the Czech Republic started the complex recodification of substantive and procedural criminal law. During this year the revision of former Government proposal of a new Criminal Code was made. After the interresort reminder procedure the proposal was moved to the Government in the last quarter of this year and came into the next period of the recodification process. The upcoming recodification of criminal substantive law forms hand in hand with the recodification of procedural criminal law the need of the new Criminal Code. Furthermore, the optional process of legislative proceedings in 2008 shall result in approval of the Criminal Code which shall come into effect on January 1, 2009.

It is no wonder that the theme of the Criminal Law Section of the conference "Days of Public Law" is called "Actual Issues of the Criminal Law Reform". The conference papers from participants deal not only with the difficulties arising from the new Criminal Code but also with the influence of European Law on the Czech legal order and other less important issues connected with the criminal law reform.

The Slovak Republic is a step further in the trend of criminal law reform with the comprehensive recodification entered into effect in 2005. Our colleagues from the Slovak Republic have shared in their papers their knowledge and stimulations of these changes and the major problems of Slovak criminal law.

We hope the conference papers will be of benefit to not only to criminal law interested persons.
